Know Your Rights
as a Tourist Entering the United States

Traveling to the United States as a visitor is exciting, but many tourists find themselves uncertain about what to expect when dealing with Customs and Border Protection (CBP) officers. At Keller Law Group, we believe it's essential for every visitor to understand their rights at the border because knowing what to expect is the first step toward a stress-free entry.

1. The Border Is Not a Free Zone, But You Still Have Rights

U.S. ports of entry, including airports and land borders, are not places where the full scope of constitutional protections automatically applies. Border officers have broader authority to question travelers and inspect their belongings, even without a warrant. That said, you still have rights, and officers must treat you respectfully and without discrimination.

2. You Must Answer Basic Questions

CBP officers will likely ask you about your travel plans, the purpose of your visit, where you’re staying, and how long you plan to remain in the U.S. These questions are standard, and you are required to answer them truthfully. Failure to cooperate could result in denial of entry.

However, you are not required to answer detailed or intrusive personal questions beyond your immigration-related information, unless you're suspected of wrongdoing.

3. Your Phone and Laptop Can Be Searched, Even Without Suspicion

Border officers are legally allowed to inspect your electronic devices, including your phone, laptop, and tablet. They do not need probable cause to do so at the border. If you're carrying sensitive data, whether personal or work-related, it’s a good idea to minimize what you bring or store sensitive materials in secure, cloud-based accounts that are not accessible from your devices.

Refusing to provide passwords may result in your device being confiscated or denial of entry. However, you can politely express concerns and ask for legal counsel, especially if you're a U.S. citizen or lawful permanent resident

4. You Can Be Denied Entry, Even With a Valid Visa

Holding a valid tourist visa does not guarantee that you’ll be allowed into the U.S. Entry is always at the discretion of CBP. If officers believe you’re entering for a reason beyond your visa’s scope, such as working without authorization or intending to overstay, they can deny you entry.

That’s why it's crucial to carry supporting documents like a return ticket, proof of hotel bookings, or an itinerary to show your intent to return home

5. You Can Ask for an Interpreter

If you’re not fluent in English, you have the right to request an interpreter to ensure you fully understand the questions being asked and the answers you’re giving. Do not sign any documents unless you’re sure you understand them.

6. You Have the Right to Leave

As long as you're not under arrest, you can withdraw your application for entry and choose to return to your home country voluntarily instead of facing formal removal proceedings. This is usually a better alternative to being denied entry with a mark on your immigration record.

7. If You’re Detained, You Can Seek Legal Assistance

If you’re detained at the airport or border, you have the right to legal representation, but at your own expense. While CBP does not have to delay their process to wait for your attorney, especially if you're not a U.S. citizen or green card holder, contacting a lawyer can still help prevent future immigration consequences.

If you're a permanent resident or someone who’s already in the U.S. on a different visa and is reentering, you may have additional rights and should consult an attorney immediately if you're held for secondary inspection
